contacted me via telephone and began threatning me saying he was going to contact the police....if so can he and what can he file against me|||He can report you for knowingly being in possession of a stolen vehicle, along with hiding the property of another (the bank/lending agent) from it's rightful owner.|||Theft of a motorvehicle for one. It's pretty serious. Pay for your car or give it back.
.|||A car loan is secured by the car. If you default on the loan, the finance company may have sold its interest in the car to a collection agency. That agency has the right to repossess the car. Contacting you only ensured that you still have the car, so you can expect a visit in the middle of the night from a tow truck which can scoop your car and be down the street in about 30 seconds. I don't think they'll "file" anything against you. They'll just take the car. And yes, they can contact the police. Anyone can contact the police. Probably not to get you arrested, but to make sure they know you're about to file a "stolen car" claim.
All this presumes that the caller has a tow truck. If it's a collection agency, they may only have telephones. These guys are good at scaring you if you skip your credit card payments. And they never give up, either. But that's another type of caller. Can't tell if the one who called you is a scummy collection agency or a towing company, checking to see if you still have the car. Good luck!!|||he's telling you that if he comes to pick up your vehicle and you attempt to hide it from him---he can have you arrested for "impairment of secured collateral".
